We wish to inform you in order to establish, maintain and carry out the working relationship between your company and our own, we have acquired the necessary Data regarding your company. These Data were acquired by verbal communication, either directly or from Third Parties, and would qualify as Personal Data under the terms of the legal decree known as D. Lgs 196/2003 (as stated in the Code dealing with the Protection of Personal Data).
The afore-said Code establishes that any person or persons dealing with Personal Data must inform the person concerned, specifying which data are handled, and also detailing any elements which qualify the handling of the Data. Any procedure involving Personal Data must be carried out correctly, in all due respect of the relevant laws, and with absolute clarity, in order to safeguard your privacy and your rights.
Therefore, in respect of the terms of the above - stated regulations, we hereby inform you of the following points:

Type of Data handled.
We handle the following aspects of your Personal data:

* Name, address or other elements of personal identification.
    * Education, general culture.
    * Professional or occupational background
    * Lifestyle or habits
      These elements are essential in order to conduct any working relationship, both for already-existing relationships, or for any which may arise in future.
      We do not hold any of your Data which qualify as sensitive Data ( under the terms of article 4, letter d, of the Code); also, we do not hold any judicial Data (under the terms of article 4, letter e, of the Code).

The purposes of Data handling
Your Data may be handled in connection with the following needs or demands:

* Client management
    * Post-sales assistance
    * Aims connected to the type of business activity
    * Customer satisfaction surveys
    * Sales promotion campaigns, conducted via fax, e-mail, sms or other direct marketing means or methods
      Marketing
    * Games or competitions, prize- incentivised
    * Consumer and user protection service
    * Commercial handling of Data
    * Client or consumer profiles.
      These Data will be handled throughout the time of the whole working relationship, and may also be held back in subsequent times, in order to meet any legal requirements.

Handling procedures
All Data will be handled with the use of suitable equipment and procedures, so as to guarantee the security and private nature of the Data themselves. Data handling may be conducted as follows:

* By automatic handling, using electronic equipment
    * By simple office work procedures, such as filing of papers or documents
    * Data processing may also be contracted out to Third Parties
      Data processing may also apply to data collected from Third Parties
    * Client profiles
    * Confirmation and any alteration of Data only on request of the subject him/herself
    * Data collection directly from the subject
    * Data collection by telephone or electronic equipment
    * Data collection by electronic means
    * Data collection by forms, coupons and questionnaires.

Obligations or rights concerning the Supply of Data
This point regards any Data which we are legally obliged to know, in order to conform to the legal requirements, regulations and the UE legislation. This includes any regulations or norms established by the legitimate competent Authorities, and by those organs responsible for supervision and control. Any failure on your part to supply us with these Data will imply that we shall not be able to establish or carry on any working relationship, to the extent that such Data are necessary to go forward with the work.
As regards any Data which we are not obliged to hold, and which we have not received, we shall evaluate each case separately, as it occurs, and this will determine any consequent decisions, in consideration of the importance that such Data may have on our organization, and considering any Data which we requested, but which were not delivered to us.

Scope of Access to your Data
The following persons, subjects, and/or company organizations, may have access to your Data, as they all hold managerial or other posts with responsibility for handling private or Personal Data, and have been appointed to this role by Sixty SpA, which, as undersigned, holds all rights for Data handling. Subjects having access are as follows:

* Board of Directors
    * Secreteriat to the Board of Directors
    * Information Systems
    * Administration Department
    * Communications Department
    * Commercial Department
    * Marketing Department
    * Web Sales Personnel
    * Retail Personnel
    * Logistics and Planning Personnel .

Range of Data Communication.
We may communicate your Data, i.e. disclose them to certain specific parties, under the following terms, and to the following parties:

* Subjects having legitimate right to access the Data, under current laws, regulations or EU legislation, within the limits established by the aforesaid laws or regulations.
    * Any subjects who need to have access to your data, for purposes connected with the working relationship between Your Company and ourselves. Any information given will be strictly limited to those items necessary to the performance of support services (for example, transport or delivery services).
    * Our professional advisors, to the extent that they need to receive information to fulfil their roles as advisors to our company. Private information will only be disclosed after our official letter of appointment, which clearly establishes the duty to maintain the privacy and security of all such Data.
    * Any companies which may be under control and/or connected or linked, and which may have access to the Data, but only to the extent that they may need to access the Data in order to perform the support services.
    * The following independently owned companies, that is: Sixty Active SpA, Sixty Factory SpA, Cruz Srl, Sixty Surplus Division Srl, Sixty Italy Retail, Murphy Italy Retail, under the terms stated herein.

Your data may be used or transferred by us to any EU member state. However, any transfer of your Data to non - EU countries will require your previous consent.

Your Rights
We bring to your attention the following articles of law, as stated in article 7 of the legislative Decree 196/2003 (known as D. Lgs. 196/2003), so as to remind you that you are entitled to exercise the following rights in our working realationship. You may:
Seek and obtain confirmation of the fact that Personal Data regarding yourselves may exist, even though they have not so far been recorded, and you may ask for these Data to be transmitted to you, in an intelligible and comprehensible form;

* Seek to obtain the sources of such Personal Data, and the purposes or ways in which they may be used;
    * Seek to obtain information about the logistic strategies used in the the handling of Data by electronic means;
    * Receive up-dated, corrected Data, and also integrated Data, should this be necessary;
    * Cancel any Data, or express them under an anonymous form, or block any Data which may have been handled in violation of the prevailing law;
    * Cancel any Data, or express them under an anonymous form, or block any data which need not be held, and which were not inherent to the original purposes of the Data collection, or the subsequent handling of such Data;
    * Obtain documents attesting that any procedures of up-dating, correction, integration, cancellation, use of anonymous forms, or data blocks have been duly communicated to all subjects concerned. This applies to the contents of the documents, which have been sent or communicated to the relevant parties, excet in those cases where communication has not been possible, or would involve the use of communicative means out of all proportion to the rights herein protected;
    * Wholly or partially object to the handling of your own Personal Data, for legitimate reasons, even though these Data may be pertinent to the aims of the Data collection;
      Wholly or partially object to the handling of Personal Data apertaining to yourselves, if these Data are to be used a advertising material or direct sales, or for market research surveys, or for other forms of commercial communication.

1 - I hereby authorize Sixty S.p.a. to collect and handle my personal data, for the purposes and with the methods as stated above.

2 - I also authorize Sixty S.p.a to carry out the optional handling procedures, as shown above, and also give my explicit consent to the holding of the data, so that future relationships may be established ; furthermore, I consent to any transfer to third parties, and to foreign transfers, including counties which are not members of the EU.
